EXAMINATION AND COMPLAINT OBLIGATION
- The Customer must examine the products as soon as possible after receipt and assess whether they meet the quality and quantity customary in normal trade. This means that the Customer must examine whether the products delivered have all the properties they should have and whether they are complete and undamaged. The Customer has 14 days to examine whether the quality and quantity of the delivered products correspond to the Agreement and whether the products meet the requirements applicable to them in normal (commercial) dealings.
- The Product cannot be returned if the packaging has been opened. By this we understand the opening of the ampule, blister, jar,.... Only the packaging material (i.e. the box) may be opened.
- Complaints must be made in writing to Dailipharma within 2 days of the occurrence of the defect. They should be submitted clearly and if necessary supported with photos and emailed to hello@dailipharma.com
- If a timely complaint is made, pursuant to the previous paragraph, the Customer remains obliged to pay for the purchased goods.
- Dailipharma strives to answer complaints In Writing with reasons within 14 (fourteen) days of receipt. If Dailipharma expects a response to take longer, it will communicate this as soon as possible.
- In any case the Customer gives Dailipharma 12 (twelve) weeks to resolve a complaint by mutual agreement. After this period the complaint is subject to dispute resolution.
- Dailipharma is entitled to investigate the authenticity of the complaint.
- If a complaint is declared founded, the Customer is entitled to repair, replacement (redelivery) or cancellation of the redelivery. In this regard, minor deviations, in the brache usual deviations and characteristics specific to the Product in question, such as quality, quantity, size, color or finish, Dailipharme can not be charged.
- Refunds to the Customer will be processed as soon as possible, but payment will be made up to 15 days after receipt of the return. Refunds will be made to the account number previously provided.
- If the Customer makes use of the right of withdrawal, the Customer will return the Product to Dailipharma to the extent reasonably possible, in its original condition and packaging, in accordance with the return instructions of Dailipharma.
- A complaint shall in no case entitle to suspension of a due obligation. In case of an order containing multiple Products, the complaint with respect to one of those Products shall not affect the obligations under the Agreement with respect to the remaining Products.
EXEMPTION FROM THE RIGHT OF WITHDRAWAL
- The right of withdrawal allows the Customer to withdraw from the Contract within the reflection period. This right is free of charge and without giving reasons, subject to the legal grounds for exception. One of these grounds for exception concerns health protection and hygiene. Products that cannot be returned after opening due to hygienic or health risks may be excluded from withdrawal.
- Dailipharma's Products are by their nature not suitable to be returned on grounds of health protection and hygiene. For this reason, it is unfortunately not possible for Customers to return Products invoking the right of withdrawal.
- However, Dailipharma always offers the Customer the possibility to return Products within 14 calendar days. This period starts from the moment of receipt by the Customer or on behalf of the Customer. In order to validly exercise his/her right of withdrawal, the Customer must notify the Seller by registered mail or email (hello@dailipharma.com) that he renounces the purchase.
- Dailipharma will refund the full purchase price, excluding shipping costs, when the purchased Products arrive back at Dailipharma's warehouse unopened and in new condition.
- Upon the compliant exercise of this right of withdrawal, the Seller will refund to the Customer, within 30 days of receipt of the withdrawal and return of the Product, the purchase amount of the returned good in the same manner as the Customer's initial method of payment.
